Examples
of incidents at different level of harm and intent
Harm-intent category |
Example of an incident at each
harm-intent level (person displaying relevant
behavior is underlined and the rationale for the intent rating is shown in
parentheses following the incident description) |
Minor nonphysical, defensive
intent (female) plus minor physical, definite intent (male) |
A male patron was seen brushing his hand across the bare midriff
of a female patron who was walking by. She suddenly stopped and placed
her hand within inches of his face, apparently signaling that she wanted him
to get away from her. (the male was
rated definite intent because of the invasiveness of the act and the female
defensive because her act was judged no more than was necessary for self-defense) |
Minor nonphysical, probable
intent |
A male patron who appeared somewhat intoxicated jumped onto a
thin plank between the backs of two benches and began to dance apparently
trying to show off for his friends. A staff member motioned for him to get
down which he did. About 20 seconds later, however, the patron looked around
for the staff member and, when he did not see him, jumped back up on the
plank and began dancing again. (the patron’s behavior was coded as
aggressive rule breaking because of his continuing to rule break after being
asked to stop, with probable(not definite) intent because his intoxication
level made it uncertain whether any harm was intended) |
Moderate nonphysical, probable
intent |
A male patron grabbed his male friend by the arm and said, “Hey,
you see her!? You checking her out!? [about a female
on the dance floor] You should be dancing up on that shit, man!” The second
male indicated that he did not want to approach the female. The first male
continued to pester and push his friend, saying, “C’mon man! What’s your
problem? Go dance with her! What? Aren’t you a real man?” (the first man
appeared to be bullying but was rated only probable rather than definite
intent because it was not certain that he intended harm to his friend) |
Moderate nonphysical, definite
intent |
Two groups of about 8 patrons divided by a pool table were arguing
angrily using obscenities and taking threatening steps toward one another. At
one point, one man was held back by his friend while he exchanged a few loud
words with another man. Staff intervened, settling the group down and asked
some of the men to leave (clearly threatening and aggressive behavior by
the men who were arguing with no reason to doubt intent). |
Minor physical, defensive intent
(female), probable intent (male) |
A male patron who was conspicuously staring at all single
females who passed him on the way to the dance floor,
grabbed the hand of one passing female and pulled her toward him. The female
grimaced and pulled her hand away. (male rated probable on intent rather
than definite because he may have intended to initiate friendly contact with
a female, the female was rated defensive intent because her action was judged
no more than necessary for self-defense) |
Minor physical with moderate-severe
nonphysical, probable intent |
An intoxicated male stumbled into a female causing her to fall from her
stool. A second female who saw the incident jumped up and grabbed the
man’s arm and spoke very aggressively to him. She appeared upset and angry with
the man and was waving her hand adamantly, telling him off. (the female
who intervened was rated probable rather than defensive because her actions
appeared to be more aggressive than necessary to defend her friend, but she
was not rated definite intent because of the defensive aspect of her behavior
in that she was apparently trying to prevent the male from causing more
serious harm) |
Minor physical with
moderate-severe nonphysical, definite intent (first male) plus minor
nonphysical, definite intent (second male) |
When the male of a male-female couple left to go to the
restroom, a second male sat down with the female and began talking to her.
When the first male returned to the table, he yelled at the second male
“Why are you butting in on my table?!” “Get the fuck out of the chair!” The
second male scowled and said something back. A staff member got between the
two males with one hand on each chest saying “Cut it out you guys!” He yelled
at the first male, telling him to “Sit down!” The second male had a mocking
grin that infuriated the first male who kept trying to get to the second male
by swiping the staff member’s hand away in order to move around him. The
staff member lightly grabbed the first man’s arm but the man pulled it away,
clenched it into a fist and yelled, “Get your hands off me. I’ll pop you one!
Don’t you fucking touch me!” Eventually the staff
member was able to calm the man down. (first male clearly exhibited
definite intent both toward the other male and the staff member; the second
man was also rated as definite intent because of his purposely taunting
behavior) |
Moderate physical, defensive
intent (two male interveners) plus severe physical, definite intent (the two
fighters) |
Two males were in a heated argument at the front of the taxi
line up outside the bar. They began to shove each other back and forth and
then started punching each other. Two other males pulled on the second
man’s waist to remove him from the grasp of the first man, but the first man
overpowered their attempt to remove the second man .
He repeatedly kneed the second man in the face and chest approximately 12-15
times with great force. Finally, a friend of the first man pulled him away.
While the friend pulled the first man away, the second man was shouting “ you wanna fuck with me?”
Although he looked visibly shaken by the incident, he was smiling, but was
also bent forward apparently in pain. (the two men who grabbed the second
man in order to pull him away from the first man who was hitting him were
rated as defensive intent because their acts were no more than necessary to
try to prevent men from fighting; the two males actually in the fight were
rated severe aggression, definite intent) |
Moderate physical, probable
intent |
One male forcefully pushed his friend. Though it was a forceful push,
it was clearly horseplay. The two men then began to push each other back and
forth about 5 times (still horseplay) until one of the men who was quite
intoxicated stumbled backwards and fell into the seat of a booth. When he got
up, he walked over to the other man and put him in a head lock and kept
attempting to provoke him and push him, not in a hurtful way, but apparently
to egg him on to fight. His friend defended himself but did not respond, and
the incident ended. (the man who put his friend in a headlock was rated
probable on intent because his persistence indicated more aggression than
mutual horseplay; however, the horseplay element made definite intent
uncertain) |
Moderate physical, definite
intent |
Two men were pushing each other’s chests beside the dance
floor. One man then pushed the other harder (in the chest) moving the second
man back 5-6 feet. The two men looked at each other for a few seconds and
then the second man turned around and walked a few steps away. (the pushing by both men was clearly aggressive
with no reason to doubt aggressive intent). |
Moderate physical with
moderate-severe nonphysical, defensive intent |
A man was trying to move towards the bar but a second man was
standing in front of him, forcibly holding him back and pushing him toward
the door. The first man was pushing and struggling aggressively, and the two
men were yelling at each other. Two other men assisted in holding the first
man back. (the second man was rated
defensive intent because his pushing and yelling seemed to be to protect his
friend from attacking someone at the bar). |
Moderate physical with
moderate-severe nonphysical, probable intent |
Two men were outside the bar yelling at the staff. A female friend
shoved one of the males quite hard with both hands on his chest and screamed
at him. (because the level of aggression
displayed by the female appeared to be more than necessary for the situation,
she was rated probable intent rather than defensive intent in her attempt to
stop the male from arguing with bar staff). |
Moderate physical with
moderate-severe nonphysical, definite intent |
A scuffle broke out on the dance floor which mainly involved patrons
pushing each other and some trying to restrain others. One man grabbed
another man around the shoulders/neck and began yelling in his face. After
the two men pushed and shoved each other for about 30 seconds, staff and
other patrons separated and restrained them. (the man’s behavior appeared
to be clearly aggressive with intent to harm) |
Severe physical, probable intent |
Among a group of males who were drinking heavily, two males were
engaged in intermittent mild horseplay. Suddenly one of the males,
with his fists held together as a battering ram, slammed into the chest of
the smaller male. The force of the blast, coupled with extreme drunkenness
and the complete surprise of the blow, sent the other male flying off of his
feet and backwards through the air several feet landing squarely on his back.
(the man’s behavior was rated probable rather than definite even though he
would have caused pain to the other man because he may have intended the act
as part of horseplay and used more force than intended because of
intoxication ) |
